CAC Appointment - INFORMATION The Plans and Programs Committee will consider recommending appointment of one member to the CAC at its September 22 meeting. This vacancy resulted from the term expiration of Cecilia Lim. Neither staff nor CAC members make recommendations regarding CAC appointments. Adopt a Motion of Support for Approval of the 2009 Prop K 5-Year Prioritization Program for BART Station Access, Safety & Capacity and Approval of the 2009 Prop K 5-Year Prioritization Program for Traffic Calming, with Conditions - ACTION* attachment The voter-approved Prop K Expenditure Plan requires that each programmatic category (i.e., not project specific) develop a 5-Year Prioritization Program (5YPP) as a prerequisite for receiving Prop K allocations. This requirement applies to 21 programs such as new signals and signs, street resurfacing, pedestrian circulation and safety, and tree planting and maintenance. The intended outcome of the 5YPPs is the establishment of a steady stream of grant-ready projects that can be advanced as soon as funds (including Prop K, federal, state, and other) are available. While the Strategic Plan provides the long-term road map for managing Prop K revenue, the 5YPPs ensure that the Authority Board, the Citizens Advisory Committee (CAC), project sponsors and the public have a clear understanding of how projects are prioritized for funding within each particular programmatic category as well as the five-year program of projects anticipated to be delivered. The provisionally adopted 2009 Prop K Strategic Plan, approved in July 2009, informed the preparation of each 5YPP, particularly the allowable annual funding levels and associated financing costs for those categories where sponsors wish to advance Prop K funds to accelerate project delivery. In addition to outreach efforts undertaken by project sponsors, the Authority hosted four public open houses in July and August 2009. We are recommending approval of the BART Station Access, Safety & Capacity 5YPP at this time, which is consistent with the 2009 Strategic Plan. We are also recommending approval of the Traffic Calming 5YPP, with conditions, pending the Municipal Transportation Agency's (MTA's) submission of estimated completion dates for currently underway traffic calming planning projects, as well as the total cost to implement completed planning projects, which we anticipate receiving prior to the October 20, 2009 Plans and Programs Committee meeting. This information is necessary for the Authority to assess the capacity of the MTA Traffic Calming Program to complete currently underway planning projects and implement completed planning projects while undertaking new planning efforts. We anticipate that the remaining 5YPPs will be presented to the CAC in the next two months. We are seeking a motion of support for approval of the 2009 Prop K 5YPP for BART Station Access, Safety & Capacity and conditional approval of the 2009 Prop K 5YPP for Traffic Calming, with conditions. 6. Adopt a Motion of Support for the Allocation of $356,000 in Prop K Funds, with Conditions, to the Municipal Transportation Agency (MTA) for the Fiscal Year 2009/10 Traffic Calming Planning, Evaluation and Outreach Projects, Subject to the Attached Fiscal Year Cash Flow Distribution Schedule - ACTION* attachment The Municipal Transportation Agency's (MTA's) Traffic Calming Program was created to improve safety on San Francisco's streets by addressing some of the traffic problems associated with the growing number of cars in San Francisco and to make neighborhood streets friendlier for pedestrians, children, bicyclists, and motorists. The MTA requests a total of $356,000 in Prop K funds to evaluate traffic calming applications, to perform outreach and to complete four traffic calming planning projects. The subject request would fund MTA's evaluation of approximately 30 to 60 traffic calming applications, the participation of MTA staff in neighborhood meetings to explain the program and how residents can participate, the development of materials to publicize and promote the program, and update the Traffic Calming Program website. It would also provide funding for the development of plans for two Local Streets projects (Minna/Natoma and South Silver Terrace) and two Arterial projects (Mission Avenue from Cesar Chavez to 30th Street and Folsom Street from 10th Street to 19th Street). This allocation is contingent upon the Authority Board approval of the 2009 5-Year Prioritization Program (5YPP) update for the Traffic Calming category, as well as upon the MTA providing additional information on completed and currently underway traffic calming plans, which we anticipate receiving prior to the October 20, 2009 Plans and Programs Committee meeting. We are seeking a motion of support for the allocation of $356,000 in Prop K funds, with conditions, to the MTA for the Fiscal Year 2009/10 Traffic Calming Planning, Evaluation and Outreach Projects, subject to the attached Fiscal Year Cash Flow Distribution Schedule. 7:00 Capital Projects 7. Adopt a Motion of Support Authorizing the Executive Director to Execute Cooperative Agreements (No. 4-2283 and 4-2137) with Caltrans; Amendment to Memorandum of Agreement with the Treasure Island Development Authority; and Amendment to AECOM Professional Services Contract - ACTION* attachment The Authority is working jointly with the Treasure Island Development Authority (TIDA) on the Yerba Buena Island (YBI) Ramps Improvement Project. Under Memorandum of Agreement (MOA), TIDA has the responsibility to reimburse all Authority costs incurred on the project. Initial reimbursements by TIDA were capped at $3,000,000. In May 2009 the Authority approved an amendment to the MOA with TIDA to increase the authorized amount to $8,800,000 and a corresponding amendment to the AECOM professional services contract. In order to build the YBI ramps in conjunction with the construction of the new Eastern Span of the San Francisco-Oakland Bay Bridge (SFOBB), two critical Cooperative Agreements (No. 4-2283 & 4-2137) need to be executed with Caltrans. TIDA is requesting that the Authority execute these two agreements with Caltrans and a corresponding amendment to MOA to allow for reimbursement of Caltrans estimated capital and support costs. In addition, TIDA is requesting that the Authority amend the terms of the existing AECOM engineering contract consistent with the proposed MOA amendment. The TIDA MOA authorized amount of $8,800,000 will not be increased at this time, but instead funds will be temporarily shifted from the AECOM professional services contract line item. We are seeking a motion of support authorizing the Executive Director to execute Cooperative Agreements (No. 4-2283 and 4-2137) with Caltrans, amendment to the MOA with TIDA, and amendment to AECOM Professional Services Contract. 8. Status Update on the Doyle Drive Replacement Project - INFORMATION Pre-construction work is now underway for the Doyle Drive Replacement Project and Caltrans is expected to open bids for the first major construction contract in October 2009. Lee Saage, Deputy Director for Capital Projects, will present a project update focused on transportation management during construction and efforts underway to promote small business contracting and workforce development. This is an information item. 7:40 Finance and Administration 9. Adopt a Motion of Support to Authorize the Executive Director to Execute and Deliver an Amendment to the Credit Agreement and Related Amendments to Certain Other Documents Relating to the Authority's Commercial Paper Notes, and to Take All Actions Necessary in Connection with Such Amendments - ACTION* attachment In March 2004, the Authority issued an initial tranche of $50,000,000 and, in September 2004, a second tranche of $100,000,000 of a programmed $200,000,000 aggregate principal amount of commercial paper notes (Limited Tax Bonds), Series A and B (the "Notes"). The commercial paper notes are issued to provide a flexible source of financing for the voter-approved Prop K Expenditure Plan. To support the payment of principal and interest on maturing notes, the Authority obtained a line of credit (the "Credit Agreement") from Landesbank Baden-Württemberg, acting through its New York Branch ("LBBW"). Pursuant to the original terms, LBBW can terminate the agreement on April 13, 2010. LBBW has proposed to continue the line of credit until April 13, 2013, contingent upon the Authority's agreement to new terms and conditions set forth in a term sheet provided by LBBW. We are seeking a motion of support to authorize the Executive Director to execute and deliver an amendment to the Credit Agreement and related amendments to certain other documents relating to the Authority's Commercial Paper Notes, and to take all actions necessary in connection with such amendments. 7:50 10.
