4.                  Adopt a Motion of Support for the Amendment of the Administrative Code - ACTION* attachment

It is at the Authority's discretion to review the Administrative Code to ensure compliance with current statutes and Authority objectives. For Fiscal Year 2010/11, at the request of Authority Board and Personnel Committee Chair Ross Mirkarimi, and to allow for increased flexibility and consistency, we are recommending approval of minor updates to the Administrative Code for meeting days and the annual performance evaluation deadline.  We are seeking a motion of support for the amendment of the Administrative Code.

5.                  Investment Report for the Quarter Ended June 30, 2010 - INFORMATION* attachment

The Authority's Investment Policy directs that a review of portfolio compliance be presented quarterly.  As year-end closing is still underway, the investment report for the quarter ended June 30, 2010 is presented independently. Following the annual audit, the Basic Financial Statements will be presented to the CAC along with the results of the fiscal audit, single audit, and management review.  This is an information item.

6.                  Adopt a Motion of Support to Execute the Option with VNO Patson Van Ness Holding LLC to Extend the Office Workspace Lease for an Additional Five Years, in a Total Amount not to Exceed the Fair Market Rental Value, and Authorize the Executive Director to Negotiate Terms and Conditions - ACTION* attachment

In October 1993, the Authority relocated its offices from City Hall to the building located at 100 Van Ness Avenue in order to provide sufficient space for its activities as administrator of the Prop B half-cent sales tax for transportation, congestion management agency, and county program manager for the Transportation Fund for Clean Air.  The 26th floor lease term expires in August 2011 and includes an option to extend the lease for an additional five-year term at fair market rate. After surveying the leasing options available in the Civic Center, the Embarcadero, and South of Market (SoMa) districts, we determined that the existing office workspace is deemed to be the best advantage of the Authority with respect to financial impacts and meeting our space requirements.  According to the existing lease, the annual base rent for the extended term shall be equal to the fair market rental value of the office space as of August 2011, but be no less than the current annual rent of $382,265.  We are seeking a motion of support to execute the option with VNO Patson Van Ness Holding LLC to extend the office workspace lease for an additional five years, in a total amount not to exceed the fair market rental value, and authorize the Executive Director to negotiate terms and conditions.

7.                  Adopt a Motion of Support for the Allocation of $567,778 in Prop K Funds, with Conditions, for Five Requests, Subject to the Attached Fiscal Year Cash Flow Distribution Schedules, and Amendment of the Bicycle Circulation and Safety 5-Year Prioritization Program - ACTION* attachment   enclosure

We have five Prop K allocation requests to present to the Citizens Advisory Committee (CAC) at the September 1 meeting for potential approval by the Authority Board later that month. The requests total $567,778 and include four Municipal Transportation Agency (MTA) projects and one from the Planning Department.  As summarized in Attachments 1 and 2, the projects include upgrade and reactivation of Muni's Bernal Substation; implementation of three bicycle facilities adding about 2.5 miles to the bicycle network; MTA bicycle safety education and outreach activities such as producing bicycle collision analysis reports and updated bike route network maps; and providing a local match for the Planning Department's Cesar Chavez East Community Design Plan. Attachment 3 provides a summary of our staff recommendation, highlighting issues of potential interest to the CAC, such as recommended special conditions.  The Authority Board has previously approved the 2009 Prop K 5-Year Prioritization Program (5YPP) update for the relevant Prop K categories.  The bicycle facilities request requires a minor 5YPP amendment to add new projects. The 5YPP would remain consistent with the Strategic Plan programming and financing assumptions. We are seeking a motion of support for the allocation of $567,778 in Prop K funds, with conditions, for five requests, subject to the attached Fiscal Year Cash Flow Distribution Schedules, and amendment of the Bicycle Circulation and Safety 5YPP.

6:40     Capital Projects

8.                  Update on the Municipal Transportation Agency's Central Subway Project - INFORMATION* attachment

On March 30, 2010, the Authority Board adopted the baseline budget, schedule, and funding plan for the Central Subway project. With a total budget of $1.578 million, the project is in the final design phase. Final design is being performed under three separate contracts: Tunnels, which is 57% complete; Stations, 9.7% complete; and Systems, 4.7% complete. In parallel with the design efforts, Municipal Transportation Agency (MTA) staff is working on the New Starts Report, the State of Good Repair Plan, and the Fleet Management Plan for submittal to the Federal Transit Administration (FTA) in September. The MTA's work is also concentrating on the other deliverables of the Road Map to the Full Funding Grant Agreement (FFGA). The first construction contract, which is relocating utilities in the vicinity of the Moscone Center and at the tunnel portal, budgeted at $11.2 million, broke ground on February 9, 2010. This contract, now 75% complete, is scheduled to be to be completed by December 2010. The next construction packages to be advertised are the utilities relocation contract in the vicinity of Union Square, scheduled to advertise on September 3, and the tunnels contract, scheduled to advertise on January 11, 2011. For right-of-way, offers have been tendered for all the properties and MTA staff is in negotiations with the property owners. The project team received FTA approval of the Relocation and Impact Study and Last Resort Housing Plan on July 13 and the MTA expects its adoption by the MTA Board and the Board of Supervisors in September. As of the end of July 2010, the project expenditures total $7.2 million against the current funding level of $155 million. The project's funding plan remains mainly unchanged from the baseline, with one notable exception which we reported to the Board in March 2010: the to-be-determined funding amount (funding shortfall) has been reduced from $159,959,519 to $132,869,519 due to the addition of $27 million in Prop 1A High-Speed Rail Connectivity funds.  Allocation of the funds; however, has been delayed due to the lack of a State budget.  The MTA has convened a Mind the Gap Committee, which includes the Authority, to assist with identification and advocacy for funding to cover the remaining shortfalls in the funding plan.  This is an information item.

7:00     Planning

9.                  Launch for the San Francisco Transportation Plan - INFORMATION* attachment

As the Congestion Management Agency for San Francisco, the Authority is responsible for preparing a long-range transportation plan identifying goals, needs, and investment priorities for the city's transportation sector.  The purpose of this plan is to establish local priorities, provide an input to the Sustainable Communities Strategy (SCS) and Regional Transportation Plan, and position San Francisco for new federal legislative opportunities.  This summer, we launch the planning process for the San Francisco Transportation Plan (SFTP), an update to the 2004 Countywide Transportation Plan (CWTP).  Throughout the two-year planning process, the Authority will conduct extensive outreach to agencies, stakeholders, and the public, and coordinate with closely related local and regional planning efforts: the City's Climate Action Plan and Capital Improvement Plan, and the regional SCS for meeting statewide greenhouse gas emission reduction targets. The outreach associated with the SFTP launch will document accomplishments since the 2004 CWTP, and seek input on the goals for this update: 1) strengthen the city's regional competitiveness; 2) create a more livable city; 3) ensure a healthy environment; and 4) provide and sustain world-class infrastructure.  The SFTP will identify investment, policy, and institutional strategies for achieving these goals.  We will seek input from a technical advisory committee and stakeholder advisory committee throughout development of the CWTP.  We are seeking comments and input from the Committee.

10.               Appoint Three CAC Members to Serve on the Community Advisory Group for the San Francisco Transportation Plan - ACTION

The Authority is now initiating the San Francisco Transportation Plan (SFTP) and wishes to convene a Community Advisory Committee (SFTP CAC) to advise staff on the plan's development. The purpose of the SFTP CAC will be to provide input on each step of the planning process, to liaise with their communities and strengthen the plan's public involvement activities overall. The SFTP CAC will advise on all aspects of the update process, including the formulation and evaluation of alternatives, selection of a preferred alternative, development of an implementation strategy (including an investment and policy component) and strategies for effective outreach. The SFTP update process will last approximately 18-24 months. We anticipate that the SFTP CAC will meet quarterly, or 6-8 times during the course of the project. The SFTP CAC will consist of approximately 18 members. Of these, three will be selected from among members of the Authority's Citizens Advisory Committee, four will be identified through a citywide application process and the rest will be invited to serve by the Executive Director of the Authority. In addition to the SFTP CAC, there will be a Technical Advisory Committee for the SFTP, consisting of staff representatives from relevant local and regional agencies. We are seeking appointment of three Citizens Advisory Committee members to serve on the Community Advisory Committee for the San Francisco Transportation Plan.
